Brunswick Row Public Spaces Protection Order (PSPO) 2026

Notice of Consultation

Notice is hereby given that Brighton & Hove City Council (“the City Council”) proposes to renew the existing and above-mentioned Public Spaces Protection Order under Section 59, 64 and 72 of the Antisocial Behaviour, Crime and Policing Act 2014. The order will allow the gated restriction of the public right of way over the highway known as Brunswick Row which links Ditchling Road with Queens Place to remain in place for up to 3 years. 

The restriction will not affect the occupiers of properties within or adjoining the affected area, as they will be given access to the gates, and the alternative route for pedestrians will be along Queens Place or Oxford Place. 

Under the terms of this order, the gates will be locked at 6pm and unlocked at 8am.   

Management of the gate locking and all other aspects of upkeep and maintenance will fall to residents within the affected area and this will be governed by a separate community agreement.  

Any written representations or objections to the draft order should be sent to the Community Engagement Team no later than 10 August 2026. Please state the grounds on which they are made.

Draft Order

Brighton & Hove City Council in exercise of its powers under sections 59, 64 and 72 of the Anti-social Behaviour, Crime and Policing Act 2014 (“the Act”) herby makes the following Order:- 

1.  This Order shall come into operation on xxxxxxxxxx and shall have effect for a period of 3 years thereafter, unless extended by further orders under the Council's statutory powers. 

2. This Order relates to that part of the public highway known as Brunswick Row as is shown coloured green on the attached plan (“the Restricted Area”) 

3. This Order authorises that entry to the Restricted Area is restricted between the hours of  1800 and 0800 every day (“the Restricted Hours”) by lockable gates at both ends of the Restricted Area (“the Gates”). The owners and occupiers of properties in Brunswick Row and Ditchling Road within and adjoining the Restricted Area will not be affected by this order 

4. The alternative route for pedestrians will be along Queens Place or Oxford Place 

5. Responsibility for locking, unlocking and the maintenance of the gates will lie with the residents and businesses within the affected area and will be governed by a management agreement which will be put in place before this order is enacted. 

6. The Council is satisfied that the conditions set out in Sections 59, 64 and 72 of the Act have been satisfied and that it is in all the circumstances expedient to make this Order for the purposes of reducing crime and antisocial behaviour in and around the affected area. The Council makes the Order because criminal and antisocial behaviour in and around the affected area has had a detrimental effect on the quality of life of those in the locality. The effect or likely effect of this is of a persistent or continuing nature such as to make this unreasonable, and justifies the restrictions imposed by this Order. 

8. If any interested person desires to question the validity of this Order on the grounds that the Council had no power to make it or that any requirement of the Act has not been complied with in relation to this Order, he or she may apply to the High Court within 6 weeks from the date on which this Order is made.

Schedule

The footpath leading southwards from Ditchling Road Brighton, between Nos. 17 and 19, to the junction with Queens Place, between Nos. 1 and 5 Brunswick Row; approximately 36 metres with an average width of 3 metres.
